Delivery and Acceptance Regulations£¨Version 2008£©
I. Goods Delivery and Acceptance
Goods Delivery and Acceptance in the Market refers to the process of transferring ownership of goods between both parities of trading according to the stipulations in e-trading contract.

Quality Requirement |
1. For the same variety, maturity and colour should be same, regular shape, solid and plump, integrity, cleanliness and normal odor.
2. No mildewed, no germinating, no scalding(sugar¡¢freezen garlic),no rotten, no worm-bitten, no scattered petal, no wrinkled-clove and empty, no mummified garlic, no multi-layered garlic and no one-clove garlic as well as no mechanical injury. |

Limitations |
1. Standardized Goods: Sum of disqualification rate according to the Quality Requirement is on a limit of 5% calculated by weight, among it, disqualification rate in item 2 should be no more than 2.5%. In specification, sum of disqualification rate should be no more than 10% calculated by weight.
2. Substitutable Goods: If qualification rate of delivery and acceptance garlic is 80%£85% (including 80%), value will be deducted 50RMB/ton; if it is in 75£¥£80£¥(including 75%), value will deducted 100 RMB/ton£»if it is 70%£75%(including 70%), value will be deducted 150 RMB/ton£»if it is below 70%, goods delivery and acceptances would be refused.
£¨Among:¢Ù In specification grades, goods will be debased one grade when goods delivery and acceptance if disqualification rate is higher than 20%.¢ÚFor rotten, germinating, scalding, mummified garlic, sum of disqualification rate should be no mores than 2.5%.¢ÛFor rotten garlic, sum of disqualification rate should be no mores than 2.5%.(The garlic that rotten rate is morn than 2.5% but less than 7.5% will be replaced to delivery and accept , the agio will be RMB 150/ton;the part of garlic that rotten rate is morn than 2.5% but less than 7.5% will be not added to sum of disqualification after the agio has been RMB 150/ton in 2007.¢ÜFor mechanical injury, worm-bitten, scattered petal, wrinkled-clove and empty, multi-layered garlic, sum of disqualification rate should be no more than 20%.

Notes |
1.Standardized and Substitutable goods refer to hybrid garlic that is accord with the above quality and specifications
2. Price Difference in substitutable goods and standardized goods are calculated in premium and agio; premium is 100RMB/ton£¬agio is 200RMB/ton.£¨pure white garlic in the same specification, value will be added 100RMB/ton when substitutable goods delivery and acceptance£©.
3. Garlic with the transverse diameter less than 5.0 CM will be not taken as substitutable goods for delivery and acceptance.
4. Garlic whose original production place for delivery and acceptance is Pizhou that will be added 100 RMB/ton on basis of traded price at the same specification; Garlic whose original production place for delivery and acceptance is Henan that will be deducted 200 RMB/ton on basis of original trading price for the same specification.
5. The grade and standard of standard and substitutable goods will be adjusted according to annual garlic production properly.
6. Garlic delivered and accepted here refers to garlic produced in current year. |
IV. Packing Requirements
Packing requestment£ºfirst class Taixin Bright Bag (50¡Á90CM), first class or second class Taixin Bright Bag (57¡Á98CM) or Violet Net Bag (20kg).
V. Delivery and Acceptance
After goods must be registered to Bill of Goods by the Market, they can delivery and accept.
1. For garlic produced in current year, its delivery and acceptance period is July and August. Registering process of Bill of Goods is:
After harvest but before being put in constant-temperature warehouses, sellers will deliver garlic, which is accord with Q/SSD001-2006 in Shandong Shouguang Vegetable Trading Market Online Standard Criterion to goods delivery and acceptance warehouses appointed by the Market before the last but not one trading day opening according to the trading result of e-trading contract. Delivery and acceptance warehouses appointed by the market will check and safeguard garlic in the warehouses and issue uniformed goods voucher to qualified garlic. Sellers will hand over goods voucher to the Market. The Market will issue goods voucher receipt and register it to be Bill of Goods.
2. Registering process of Bill of Goods for garlic stored in constant-temperature warehouses (delivery and acceptance period is from September of current year to April of next year) is:
The garlic of being ready for delivery and acceptance that stored in the constant-temperature warehouses, sellers will hand over goods deposit voucher in accordance with Delivery and Acceptance Standard in the Market and goods grade to the Market before the last but not one trading day opening according to the trading result of e-trading contract, and it will be registered Bill of Goods by the Market.
Registering process of bill of goods registration must be finished before delivery date. After getting approval from the Market, Bill of Goods can be used to replace some relevant capital from the sellers.
3. Sellers should deliver goods to appointed delivery and acceptance places before the last but not one trading day opening, if they delayed that will be treated according to rules in the Market if they delayed.Buyers can pick up goods in appointed delivery and acceptance warehouses with bill of lading issued by the Market.
4. The delivery and acceptance warehouses will check and store goods according to standards established by the Market and the Market will open relevant bills truly. Sellers and appointed delivery and acceptance warehouses will keep one copy of the bill respectively; one copy will be kept by the Market.
5. For goods delivering and accepting in advance, buyers will submit application to the Market and the Market will coordinate and arrange relevant fairs.
6. The fees before out-warehouse will be paid by sellers and works will be responsible by sellers and delivery and acceptance warehouses, but the fees of out-warehouse (Reference Fees: RMB 12-18/tons) and weigh will be charged with buyers. The buyers¡¯ vehicle for pick-up goods should reach to the delivery and acceptance warehouses on time. After reaching, the sellers and delivery and acceptance warehouses should organize to delivery in time. The volume of out-warehouse should not be less than 250 tons in 24 hours for sellers and delivery and acceptance warehouses ,and promise that the delivered goods should finish being out during the period of the delivery and acceptance wholly.
7. The Market will inform related delivery and acceptance parties to transact goods delivery and acceptance procedures in relevant warehouse appointed by the Market according to delivery and acceptance application, matched situations and principle of quantity-first on the date of goods delivery and acceptance. If two parties of trading agree to deliver and accept goods out of the appointed delivery and acceptance warehouses, related issues would be settled by themselves and any related responsibilities will also be taken on by themselves.
8. If buyers and sellers are not matched (one buyer to many sellers, or one seller to many buyers, or many sellers to many buyers) and purchasing price is different from selling price causing by e-trading contract transferring, the Market will match the relevant buyers and sellers, goods quantities and delivery place of the expired e-trading contract on trading date in order to ensure the delivery and acceptance going smoothly.
9. The Market will issue bill of lading (according to notice of the Market, traders should go to relevant place to take bill of lading) to the buyer after receiving all the payments for goods and seller¡¯s bill of goods. If buyers agree with quality grade and quantity of goods and accept it, the Market will transfer all the payment for goods to the sellers¡¯ trading account.
With bill of lading issued by the Market, buyers can transact procedure of packing-up goods from the warehouses (the person for picking-up goods from the buyers should offer authorization proves and ID card).
10. Delivery and acceptance for garlic delivered in August will start from the first trading day of delivery month. Delivery and Acceptance for garlic in the other month will start from the sixth trading day of delivery month and finish within 7 days.
11. Quantity Error: if delivery and acceptance quantity is below 100 tons£¨including 100 tons£©£¬quantity error should be no more than 1%; if it is in 100-1000 tons£¨including 1000 tons£©, quantity error should be no more than 0.5%; if it is above 1000 tons, actual delivery and acceptance quantity error should be no more than 0.1%, and margin profit and loss between actual delivery and acceptance quantity and quantity in contract will be adjusted by the Market accordingly.
12. Delivery and Acceptance Place: delivery and acceptance warehouses appointed by the Market or goods stored place.
VI. Fees of Delivery and Acceptance
1. If delivery and acceptance quantity is below 10 tons£¨including10tons£©, the Market will charge 300 RMB once£»if it is above 10 tons, the Market will charge according to the standard of 10 RMB/ton.
2. Traded price in the market is non-tax price. If buyers need to open invoice, sellers should assist buyers to transact related procedures in related tax department and the fees will be paid by the buyers.
3. Total receivable orpayable payment for goods:£¨goods delivery and acceptance price¡Àarea price difference¡Àquality grade price difference£©¡Ágoods delivery and acceptance quantities£¨ton£©.
4. The sellers and delivery and acceptance warehouses should work well about the delivery goods, and provide better work condition and environment, can¡¯t establish artificial obstacle. The buyers should appoint 2-3 person to supervise and delivery for goods inside the warehouses.
5. The staffs in the Market have the rights to supervise the whole process about goods delivery and acceptance, have judgment rights for disturbing delivery and acceptance.
If there are troubles with both parties and delivery and acceptance warehouses during the period of the process, everyone must approve the fact of the Market staff¡¯s witness as true facts. If they can¡¯t work out troubles by consultation, everyone lodges a complaint or arbitration, everyone agree with the true facts of the Market staff¡¯s witness, which will be the basis of settling troubles.
6. Both parties can¡¯t cumber the inspection work by SGS
VII.Breaking rules and resolving
If buyers can¡¯t draw the bill of lading as proclaim in the Market in time or take the delivery vehicles to delivery and acceptance warehouses on time, which will be regards that buyers give up packing up goods. Buyers should pay 20% penalty for sellers; the Market was responsible for transferring. If the sellers can¡¯t take the goods to buyers¡¯ delivery vehicles on time, which will be regard that buyers can¡¯t delivery; Sellers should pay 20% penalty for buyers; the Market was responsible for transferring. If sellers can¡¯t deliver goods because of delivery and acceptance warehouses, which delivery and acceptance warehouses will toward sellers to undertake indemnification responsibility. The sellers can protest right for delivery and acceptance by litigation¡¢arbitrage or other ways.Since buyers receive the bill of lading within 24 hours, if has had some demurrals for the quantity grade of goods, buyers should inform the Market and sellers in writing. Sellers must supply the Inspection Report about these goods by SGS, when buyers have some demurrals within 72 hours. (If there were some cases, was put forward by SGS, then postpone appropriately. Inspection fees will be prepaid by sellers and inspection result is the last proof whether goods grade is qualified or not.If checking result by SGS is less than quality grade stated in bill of goods, but accord with the substitute goods mentioned in regulation Q/SSD001-2006 of Shandong Shouguang Vegetable Trading Market Online Standard Criterion, checking fees will be paid by sellers; if checking result by SGS is accord with or more than quality grade stated in bill of goods, checking fees will be responsible with buyers.After receiving checking report by SGS, the Market will calculate price difference and relevant fees according to the checking result by SGS, manage goods delivery and acceptance, transfer capital. If goods were not accord with the standard goods or substitutable goods mentioned in regulation Q/SSD 001-2006 of Shandong Shouguang Vegetable Trading Market Online Standard Criterion, which means sellers has broken the contract and inspecting fees would be paid by sellers. Both parties can discuss and resolve it by themselves; if they fail to reach an agreement, goods can¡¯t be delivered and accepted. The Market will deduct 20% of the payments for goods from sellers to buyers and the balance transfer to buyers within 3 trading day after finishing delivery and acceptance. If it is qualified or has no demurral from buyers after checking up, the Market will calculate received and paid payments for goods and settle related fees after issuing related documents. After advocating SGS to inspect goods delivered and accepted goods, the inspecting fees will be responsible according to related regulations by Shandong Shouguang Vegetable Trading Market Online Trading Management Regulation and the traveling and hotel expenses of SGS staff will be charged with traders demurred.
The Regulations have amended the related items in Shandong Shouguang Vegetable Trading Market Online Trading Management Regulation, and will be in effect from publicized day.
The explaining rights for the Regulation reserved to Shandong Shouguang Vegetable Trading Market Online, the Market is authorized to amend the items in the Regulation.
